Terms of Use

1. Agreement

By downloading, installing or using CIRCLE: Private Chat (“CIRCLE”, “the app” or “the service”), you agree to these Terms of Use, our Community Guidelines and our Privacy Policy. CIRCLE is provided by PT JIJI LABS DIGITAL, a company established in Indonesia (“we”, “us”). If you do not agree, do not use CIRCLE.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use CIRCLE on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

2. Eligibility and accounts

• You must be at least 13 years old, or older if the law where you live requires a higher age. If you are under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms.
• You sign in with Apple. Keep your Apple Account and your device secure. You are responsible for activity on your account.
• Your @handle and display name must not impersonate anyone or infringe anyone’s rights. We may reclaim or change a handle that breaks these rules.
• You may not create accounts to get around a block or a ban.

3. Zero tolerance for objectionable content and abusive users

CIRCLE has zero tolerance for objectionable content and abusive behaviour. Content and conduct that breaks our Community Guidelines, including harassment, hate, threats, sexual content involving minors, non-consensual intimate imagery, spam and scams, will lead to removal of the content and suspension or permanent banning of the account. Child sexual abuse material is reported to the relevant authorities.

4. Acceptable use

You agree not to use CIRCLE to:

• harass, bully, threaten, stalk or intimidate anyone;
• post or send hateful content, or content that promotes violence or terrorism;
• share sexual content involving minors, or intimate images of anyone without their consent;
• send spam, run scams or phishing, or distribute malware;
• impersonate a person or organisation, or misrepresent your identity in a misleading way;
• buy, sell or promote illegal goods or services, or otherwise break the law;
• infringe intellectual property, privacy or other rights of others;
• interfere with, overload, reverse engineer or gain unauthorised access to the service or other users’ accounts, or scrape or harvest data;
• use automated means to create accounts or send messages.

5. Reporting, blocking and moderation

• Report: in a chat, open the menu and choose Report to flag an account or conversation.
• Block: choose Block in the same menu. A blocked person can no longer message you.
• Chat requests: people you haven’t accepted can only send a request. They cannot message you until you accept, and you can decline or block.

We review reports within 24 hours. When we find a violation, we remove the offending content where we are able to and suspend or ban the account responsible. Because chats are end-to-end encrypted, we can’t read message content on our servers; we act on reports, the information provided with them and the account and profile information available to us. You can also report concerns to support@jijilabsdigital.com.

6. Your content

You own the messages, photos and other content you send (“your content”) and are responsible for it. You give us a limited, worldwide, royalty-free licence to store, transmit and display your content only as needed to operate and provide CIRCLE to you and the people you communicate with (for example, delivering encrypted messages and showing your profile, Vibe and Halos). This licence ends when your content is deleted from our systems, except for copies already delivered to recipients. We do not use your content for advertising or to train AI models.

7. The service

We may change, add or remove features, and we may suspend the service for maintenance or security. Some features (such as on-device AI) depend on your device and iOS version. Features that rely on Apple services, such as Apple Music for Soundtrack, are also subject to Apple’s terms.

8. Suspension and termination

You can stop using CIRCLE and delete your account at any time in Settings → Delete account. We may suspend or terminate your access, without prior notice where appropriate, if you break these terms or the Community Guidelines, if required by law, or to protect users or the service. Sections 6 (to the extent of copies already delivered), 9, 10, 11 and 12 survive termination.

9. Disclaimers

CIRCLE is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted, error-free or that messages will always be delivered. AI summaries and suggestions are generated automatically on your device and may be inaccurate; check them before relying on them. We are not responsible for content sent by other users.

10. Limitation of liability

To the fullest extent permitted by law, PT JIJI LABS DIGITAL and its founder, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of or inability to use CIRCLE. Our total liability for any claim relating to CIRCLE is limited to the greater of the amount you paid us in the 12 months before the claim (if any) or IDR 1,000,000. Some jurisdictions do not allow these limits, so they may not fully apply to you. Nothing in these terms limits liability that cannot be limited by law.

11. Apple terms

You and we acknowledge that:

• These terms are between you and PT JIJI LABS DIGITAL only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for CIRCLE and its content.
• Apple has no obligation to provide maintenance or support services for CIRCLE.
• If CIRCLE fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to CIRCLE, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to CIRCLE, including product liability claims, claims that CIRCLE fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that CIRCLE or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using CIRCLE (for example, your wireless data agreement).
• Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Indonesia. We encourage you to contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved informally will be submitted to the competent courts of Indonesia, without prejudice to any mandatory consumer protection rights you have under the laws of the country where you live.

13. Changes to these terms

We may update these terms. We will change the “Last updated” date and, for material changes, notify you in the app before they take effect. Continuing to use CIRCLE after changes take effect means you accept the updated terms.
